sale- and delivery conditions The objective sale- and delivery conditions come into force when placing the first order to us. Herewith the customer agrees to them and accepts the further validity of the terms for future business connections. All orders require a written order confirmation by inter flags to enure the legal effect of the document. In case of a deviation of the order confirmation to the customer’s order excluding the constituents in the order confirmation headed by inter flags are valid. Place of delivery and payment as well as the court of jurisdiction is Salzburg. Supplies take place ex factory as far as nothing else has been agreed namely per course, post-mail, carrier or an own vehicle in our discretion. In either case the purchaser has to bear the risk. Partial delivery is reserved; if partial delivery is effected then such partial delivery shall be deemed a separate transaction with respect to the payment Prices quoted in the offer are subject to change. The carrying and packing costs as well as VAT will be added. If any cost increases appear between the sending of our offer and receiving the costumer’s order we are entitled to correct the prices of our offer. The orderer takes over the risk of a possible infringement of the author or patent rights due to a special design according to a draft he sent to us. Inter flags does not carry any warranty for the correctness of customer’s submitted samples, drafts and fair drawings. At any rate lithos, prints, templates, designs etc. remain our property. These stay our property even though the purchaser pays a part of the costs. They will be provided for follow-up orders over an appropriate period. Customary in this industry a more or short delivery of +/- 10% is reserved due to typographic reasons. A deviation of  the specification for width and length is permissible with a usual tolerance of +/-5%. The same applies for slight deviations of the graphical representation or the colour compared to the customers draft. Such deviations are usally technically conditioned despite this occurence the service is still as upon agreed. The customer is not allowed to a refusal of acceptance or departures. Indicated or prescribed delivery dates are noncommittal: we are only liable if we explicit take over the warranty. The mentioned delivery date indicates the dispatch date ex factory. In case of a delay the customer can neither claim the compensation for damage nor does he have the right to refuse acceptence or to cancel the contract. In event of an act of nature beyond control or other extraordinary occurrences which make the delivery hard or impossible we can withdraw the delivery obligation totally or partly. Duly ordered articles can neither be exchanged nor returned. Apart from stock commodity  however additional developed expenses for dispatch and packing the buyer has to carry a handling charge of 10%. Objections must be submitted within 14 days after receipt of the goods. This applies also to outwardly not recognizable failings. At the end of the term the articles apply as accepted. Complaints after use or subsequent treatment are disallowed. Delivery of complained commodity has to be set free of charge. The liability for lacks is confined to amendments or free replacements within an appropriate period. Transformation, reduction, resignation or compensation are beeing accepted as explicit barred. The delivered commodity remains our property up to the complete payment and adjustment of liabilities. Cheques and changes are accepted under usual reservation as provisional payment. The commodity may not be pawned or transferred for security. In case of resale the demand on the purchase amount the buyer assigns all claims he may have against the third party to the seller by way of security. Payments have to be done within 10 days starting from invoice date with an allowance  of 2% or 30 days net. In event of a loss of the invoice the bill of sale comes into effect with respect on the terms of payment. In case of a default of payment the replacement of all collection expenses as well as interest of 1% per month apply as agreed furthermore we are freed of all duties concerning further supply without cosideration on other agreements.
